Most Florida property policies do not cover flood damage. Flood requires a completely separate policy with its own rules, its own deadlines, and its own disputes. If you have flood damage and a policy that covers it, I know exactly how both work.

 

Flood claims have some of the strictest deadlines in insurance law. Missing a proof of loss deadline under an NFIP policy can eliminate your right to recover entirely. If you have flood damage, the time to call is now. Not after you figure things out.

WHY FLOOD CLAIMS GET DISPUTED

A separate policy, a separate process, and a separate set of problems.

Flood damage is excluded from standard homeowner and commercial property policies. It is defined as water that enters from an external rising source — storm surge, overflowing rivers or lakes, or surface water that accumulates and inundates the property. Coverage requires a separate flood policy issued either through the National Flood Insurance Program or a private flood insurer.

NFIP and private flood policies operate under rules that are fundamentally different from standard property claims. Proof of loss requirements are strict and time-sensitive. Documentation requirements are specific. The adjustment process is different. And the disputes that arise on flood claims are different from those on standard property claims.

NFIP VERSUS PRIVATE FLOOD POLICY. TWO VERY DIFFERENT CLAIMS PROCESSES.

Flood insurance in Florida comes from two sources, the National Flood Insurance Program administered by FEMA and private flood insurers who have entered the Florida market in recent years. The claims process, dispute mechanisms, and legal remedies available to you differ substantially depending on which type of policy you hold.

NFIP Policy Claims

NFIP claims are governed by federal law and operate under strict procedural requirements that have no equivalent in standard property insurance. The proof of loss deadline is sixty days from the date of loss and is not automatically extended. Missing it can eliminate your right to recover without exception. NFIP disputes also have a specific litigation process that requires following precise steps before a lawsuit can be filed. The structure of the NFIP claims process rewards policyholders who understand it and is unforgiving to those who do not.

Private Flood Policy Claims

Private flood policies operate more like standard property insurance claims. They are subject to Florida insurance law, the dispute process is more flexible, and the remedies available when a claim is underpaid or wrongly denied are broader than under the NFIP. However private flood policies vary significantly in their terms, exclusions, and coverage limits and a careful policy review is essential before any claim strategy is developed. The flexibility of the private market also means these policies are more likely to contain exclusions and limitations that require careful evaluation.
